1. Booking and Payment:
To guarantee your booking, a deposit of 50% of the total tour value is required. The remaining balance must be paid no later than 48 hours before the scheduled date. If payment is not completed within this period, the booking will be automatically canceled and the deposit will not be refunded. We accept payments via bank transfers, PayPal, credit/debit cards, and cash. All prices are in US dollars (USD) and include taxes and fees.

2. Cancellations and No Show:
Cancellations made more than 48 hours in advance may reschedule the tour date (except for Machu Picchu and non-reschedulable services), but the deposit is non-refundable. If the client does not show up on the day of the tour without prior notice ("No Show") or cancels on the same day, 100% of the amount paid is lost, as services and bookings have already been managed and costs cannot be recovered.

3. No Refund/Rescheduling:
Tickets to Machu Picchu, Rainbow Mountain, and other similar attractions are personal, non-transferable, and do not allow changes or refunds according to Peruvian authorities' regulations (Reglamento de Uso Sostenible y Visita Turística para la Conservación de la Llaqta de Machupicchu, D.S. N° 002-2022-MC).

4. Rescheduling:
One-day tours can be rescheduled with at least 48 hours' notice, subject to availability. Machu Picchu does not allow rescheduling under any circumstances. For hotels and trains, the possibility of rescheduling depends on the provider's conditions and may involve additional charges.

5. Insurance and Liability:
We strongly recommend purchasing travel insurance that covers accidents, illnesses, and cancellations. ATV Rainbow Mountain is not responsible for accidents, losses, or damages occurring during the tour. We do not offer insurance for the use of ATVs; the client assumes all risks associated with this activity.

6. Privacy and Data Protection:
Your personal data will be used exclusively for managing your booking and providing the contracted services. We do not share your information with third parties, except as required by law. We comply with Peruvian data protection regulations (Ley N° 29733 and its regulations).

7. Consumer Protection:
Our company complies with Ley N° 29571, Código de Protección y Defensa del Consumidor, guaranteeing clear, truthful information and respect for users' rights in all our services.

8. Force Majeure and Limitation of Liability:
We are not responsible for delays, cancellations, or changes caused by force majeure, such as natural disasters, strikes, government orders, or other events beyond our control. Our liability is limited to what is established by current Peruvian law (Código Civil Peruano, art. 1315).

9. Modifications to the Terms:
We reserve the right to modify these terms and conditions at any time. Updates will be published on our website and will take effect immediately. It is recommended to periodically review this section.

10. Intellectual Property:
All content on this website, including texts, images, logos, and graphic material, is the property of ATV Rainbow Mountain. Its reproduction, distribution, or unauthorized use is prohibited without prior written consent (Ley sobre el Derecho de Autor, D.L. N° 822).

11. Applicable Law and Jurisdiction:
These terms are governed by the laws of the Republic of Peru. Any dispute will be resolved by the competent courts of the city of Cusco, Peru.
