Terms and Conditions

1. Reservation and Payment:

• To secure your spot on our tours, an initial deposit of 50% of the total price is required at the time of booking. This deposit allows us to secure your place and begin the necessary preparations for your experience.
• The remaining balance (50%) must be completed at least 48 hours before the scheduled start of the tour. Without this final payment, unfortunately, we will not be able to confirm your participation and the reservation will be automatically canceled.
• We accept payments via bank transfers, PayPal, credit/debit cards, and cash at our office. Each payment will be confirmed with a receipt sent to your email.
• For groups of 5 or more, we offer customized payment options. Please consult our reservations team for more details.

All prices are expressed in United States Dollars (USD) and include the applicable taxes according to current Peruvian legislation.

2. Cancellation Policy:

• Cancellations must be made more than 48 hours before the tour: no refund will be provided but rescheduling of the tour is possible, except for Machu Picchu.
• For tours or programs lasting more than 3 days, the full payment (100%) must be made 15 days before the activity takes place.
• Last-minute or same-day cancellations are considered a NO SHOW and 100% of the service cost will be charged.

3. Non-Refundable and Non-Reschedulable Policy at 100%:

• Machu Picchu and Mountain (Machu Picchu, Wayna Picchu) Tickets: According to the policies of the Ministry of Culture and the train companies, tickets are non-refundable if not used. Additionally, ticket reservations are personal, non-transferable, and cannot be modified or refunded.
• Hotel Services (External Providers): If a cancellation is made less than 15 days before the tour, hotel services will not be refundable, as each provider has its own policies on this matter.

4. Rescheduling Policy:

• Machu Picchu Tickets: It is not possible to reschedule or refund tickets. If you wish to change the date, new tickets must be purchased.
• External Providers (Hotel and Train): If the provider allows changes without additional charges, the tour can be rescheduled without penalty. If changes are not permitted or price differences exist, the provider’s specific policies will apply, including possible charges.
• One-day tours can be rescheduled if notification is given at least 48 hours prior to the start of the service.

5. Insurance:

• Travel Insurance: It is highly recommended to purchase travel insurance before participating in our activities. ATV Rainbow Mountain is not responsible for any incidents or accidents that may occur during the activity.
• ATV Insurance: According to Peruvian legislation, there is no legal requirement to offer specific insurance for ATV usage. Therefore, we do not provide insurance for these vehicles. For greater protection, we recommend purchasing travel insurance that covers accidents or unforeseen events during the tour.

6. Privacy Policy:

• Personal data is only used for tour management.

At ATV Rainbow Mountain, we are committed to protecting our clients' privacy. The personal data we collect, such as name, email, contact information, and reservation details, is used exclusively for the management and execution of the tours we offer. This information is necessary to process bookings, send confirmations, coordinate logistical details, and ensure the best possible experience during the tour.

Furthermore, we ensure that all data is handled confidentially and in accordance with applicable privacy laws and regulations. Under no circumstances do we share, sell, or exchange our users' personal information with third parties without their express consent, except when required by law or to fulfill our contractual obligations.

7. Consumer Protection:

• The rights of consumers are guaranteed in accordance with Law No. 29571, which protects users against abusive commercial practices.
• ATV Rainbow Mountain provides clear, truthful, and timely information about the products and services offered, ensuring transparency in every transaction.

8. Liability and Limitation:

• While we strive to provide high-quality services, ATV Rainbow Mountain is not responsible for unforeseen events or force majeure cases that prevent the tour from taking place.
• Liability for personal or material damage during the tours will be limited as permitted by current Peruvian legislation.

9. Modifications to the Terms and Conditions:

• ATV Rainbow Mountain reserves the right to update or modify these terms and conditions at any time.
• Changes will be effective once published on this website, and users are advised to review them periodically.

10. Intellectual Property and Website Use:

• All content on the website, including texts, graphics, logos, and designs, is the exclusive property of ATV Rainbow Mountain or its licensors.
• Unauthorized use of any material is prohibited and may be subject to legal actions in accordance with Peruvian regulations.

11. Governing Law and Jurisdiction:

• These terms and conditions are governed by the laws of the Republic of Peru.
• Any disputes arising from the use of the services offered will be subject to the jurisdiction of Peruvian courts, unless otherwise agreed between the parties.
